As I originally understood it, I thought they meant that for the first 4K they would be able to make the new BS Game for the additional 2K they would add some other goodies and for up to 8K they would be able to add even more and then if they reached a million the last 2K would be available to do BASS2. So the way I interpreted it was that only the last 2K would be needed for the second game.
So I don't see any conflict of interest between them. But then again what do I know?

HandsFree, I was referring to this rule ( http://www.kickstarter.com/help/guidelines): 1. Funding for projects only. A project has a clear goal, like making an album, a book, or a work of art. A project will eventually be completed, and something will be produced by it. A project is not open-ended. Starting a business, for example, does not qualify as a project. The project is Broken Sword 5, so the funds are to be used for Broken Sword 5 only and not for any other games. Good to see Charles Cecil has confirmed that they will not use BS5 funds for BASS2, wouldn't want to see the project to be closed for violation of rules

Yes, but that's the rule about what goals are allowed. You can not spend an infinite amount on one project. The only rule I could find is that creators must fulfill all the rewards or provide a refund. If they make BS5 they're cool as far as the rules go. If they deliver the game I don't think they're forced to tell everyone how much it actually costed.
I specifically asked kickstarter if they have rules about what you can or can not do with the money if you receive more than you need. And they only replied that standard kickstarter and amazon fees still apply. So I can only deduct that they have no rules for that.
Still weird that they don't want to give a clear answer...
